By creating an account, accessing, or using WingVoyagers websites, apps, services, features, AI tools, community tools, event listings, trainer tools, or marketplace (collectively, the "Services"), you agree to these Terms & Conditions (the "Terms"). If you do not agree, do not use the Services.

Assent & Updates. By clicking "I Agree," creating an account, completing onboarding, or accepting an in-app notice after a material update, you consent to these Terms. We may log consent information such as user ID, timestamp, IP address if available, and the current Terms identifier as proof of agreement. For material updates, we will provide notice where required, and we may require acceptance before a user completes onboarding or continues using features affected by the update.

1) Eligibility & Accounts

  • 1.1 Minimum Age. You must be at least 18 years old to access or use the Services, including general social features, marketplace listings, meetups, events, training, trainer/school features, and account registration. By using the Services, you represent that you are at least 18 years old. If you are under 18, do not create an account, access, or use the Services.
  • 1.2 Account Registration. You agree to provide accurate, current information and to keep it updated. You are responsible for safeguarding your credentials and for all activity on your account.
  • 1.3 One Person, One Account. Do not share your account, impersonate others, create misleading profiles, or use another person's account without permission.
  • 1.4 Business Accounts. If you create a business, trainer, school, seller, or organizer account, you represent that you have authority to bind that entity and agree that "you" includes the entity.
  • 1.5 Minors. The Services are not intended for minors. Minors may not create an account, submit content, message users, share location, RSVP to events, contact trainers, or use marketplace features. We may restrict or remove accounts or content when we believe a user is under 18.

2) Critical Safety Notice - Aviation Sports Are Inherently Dangerous

  • 2.1 Assumption of Risk. Paramotoring, paragliding, hang gliding, kiting, towing, instruction, travel to flying sites, and related activities involve significant risk of injury, death, property damage, and legal consequences. You understand that these risks cannot be eliminated and voluntarily assume all risks arising from participation, including risks from pilot error, equipment failure, weather, terrain, obstacles, animals, site conditions, airspace restrictions, landowner issues, and actions or omissions of others.
  • 2.2 No Instruction or Professional Advice.WingVoyagers is not a flight school, instructor, guide, emergency service, safety authority, weather authority, or aviation regulator. Information in the Services, including flying spots, ratings, comments, messages, maps, weather overlays, airspace visuals, AI output, event listings, trainer profiles, or marketplace listings, is user-generated or informational only. It may be inaccurate, incomplete, delayed, or out of date and must not be relied on as instruction, certification, operational guidance, or safety advice.
  • 2.3 Independent Judgment. You remain solely responsible for obtaining proper training, checking authoritative sources, evaluating conditions in person, confirming permissions, maintaining equipment, flying within your limits, and making your own decisions.
  • 2.4 Compliance With Laws. You are solely responsible for knowing and complying with all applicable laws and rules, including airspace rules, site permissions, landowner permissions, local flight restrictions, equipment requirements, insurance requirements, and transport or shipping requirements.
  • 2.5 Medical Acknowledgment. You are solely responsible for assessing your fitness to participate. Consult a qualified professional before any activity, and do not fly if you are unfit, impaired, or unsure.
  • 2.6 Emergency Services. The Services are not a substitute for emergency services. Do not rely on the Services in an emergency.

3) User Conduct & Prohibited Activities

  • 3.1 Rules of Use. You agree to use the Services lawfully and respectfully. You will not violate any law or third-party right; post or transmit content that is illegal, hateful, harassing, exploitative, sexually explicit, deceptive, or that promotes harm or dangerous acts; dox, stalk, threaten, or impersonate people; interfere with or disrupt the Services; scrape or harvest data without written permission; bypass security controls; provide false site, condition, trainer, event, or gear reports; upload malware; or attempt to access non-public systems or data.
  • 3.2 Marketplace Prohibited Items. Prohibited listings include weapons, explosives, hazardous materials, stolen goods, counterfeit items, illegal drugs or paraphernalia, prescription or regulated medical devices, recalled items, items that violate export or sanctions laws, items prohibited by carriers or local law, and any aviation equipment whose sale would be illegal or knowingly unsafe. We may publish category-specific rules.
  • 3.3 Naming Restrictions. You agree not to form, register, or operate any company, entity, product, group, or business under the name "WingVoyagers" or any confusingly similar mark without our prior written consent.
  • 3.4 Incident and Crash Reports. Safety reporting is allowed and encouraged when it is factual, respectful, and submitted through appropriate reporting channels. Do not post doxxing, harassment, graphic content, unverified blame, private medical details, or defamatory allegations about a crash, instructor, trainer, guide, student, organizer, or participant. We may remove, limit, or route incident-related content to moderated review when it could affect privacy, safety, investigations, or legal rights.

4) User Content & Licenses

  • 4.1 Your Content. You retain ownership of content you submit, including posts, comments, photos, videos, messages, gear listings, ratings, spot information, event submissions, trainer profiles, and feedback. You grant WingVoyagers a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify for formatting or technical reasons, publish, display, distribute, and otherwise use your content to operate, protect, improve, and promote the Services.
  • 4.2 Content Responsibility. You are solely responsible for your content and represent that you have all rights necessary to grant the above license and that your content does not violate these Terms or any law.
  • 4.3 Privacy of Messages. Direct messages and group/instructor messages are intended for the addressed users, but they may be processed by our systems and service providers for delivery, security, abuse prevention, support, and legal compliance.
  • 4.4 Feedback. You grant us a perpetual, irrevocable, royalty-free license to use ideas, suggestions, and feedback without restriction or compensation.
  • 4.5 Monitoring. We may remove, restrict, or refuse content or accounts at our discretion, including for suspected violations, risk of harm, legal exposure, or technical abuse. We have no general obligation to monitor content.

5) Content Moderation, Reports, and Appeals

  • 5.1 Reporting. Users may report suspected illegal content, unsafe conduct, fraud, harassment, intellectual-property issues, trainer or seller misrepresentation, event concerns, or other policy violations through in-app tools where available or by emailing [email protected]. Reports should include the content, listing, profile, event, or message involved and a brief explanation.
  • 5.2 Review Tools. We may use human review, automated tools, spam filters, abuse signals, trusted reports, and account history to detect or review content. Automated tools can make mistakes, and we may update moderation tools without notice.
  • 5.3 Moderation Actions. We may remove content, reduce visibility, add warnings, hold content for review, restrict messaging or uploads, suspend verification badges, suspend seller or trainer access, disable accounts, preserve evidence, notify affected users, or contact authorities when safety or legal obligations require it.
  • 5.4 Notice and Appeals. When practical and lawful, we may notify affected users about significant moderation decisions. If you believe we made a mistake, email [email protected] with the account, content, or listing involved and the reason you are requesting review. We may decline appeals that are abusive, duplicative, unsafe, or legally constrained.
  • 5.5 Repeat Violations. We may permanently remove users, sellers, trainers, organizers, or content that repeatedly or seriously violates these Terms or creates safety, fraud, abuse, or legal risk.

6) Intellectual Property; DMCA

  • 6.1 Our IP. The Services, including brand, designs, UI, software, databases, logos, and trade dress, are protected by IP laws. You may not copy, modify, distribute, reverse engineer, or create derivative works except as expressly permitted.
  • 6.2 DMCA Notices. If you believe content infringes your copyright, send a written notice to WingVoyagers Legal Department at [email protected]. Include: your contact information; identification of the copyrighted work; identification of the allegedly infringing material and where it appears; a good-faith statement that the use is not authorized by the owner, agent, or law; a statement under penalty of perjury that the information is accurate and that you are the owner or authorized agent; and your physical or electronic signature.
  • 6.3 Repeat Infringers. We may remove content, disable access, and terminate repeat infringers in appropriate circumstances.

7) Marketplace Terms (Current Listing Platform; Future Payments)

  • 7.1 Current Marketplace Role. WingVoyagers currently provides listing, discovery, messaging, and reputation tools for gear and related marketplace activity. WingVoyagers does not currently process marketplace payments, hold funds, provide escrow, provide buyer/seller protection, arrange shipping, inspect gear, or guarantee a transaction unless a future checkout flow expressly says otherwise.
  • 7.2 Platform Role. Sellers and buyers are independent third parties. We are not a party to transactions between users, do not act as a broker, agent, insurer, or guarantor, and do not control listings, fulfillment, shipping, or in-person exchanges. We do not guarantee listings, delivery, quality, authenticity, ownership, safety, legality, pricing, returns, or that a transaction will be completed.
  • 7.3 Future Payment Processing. We may introduce in-app checkout, seller payouts, tax tools, or third-party payment processing later, including through providers such as Stripe. If we do, additional checkout disclosures, payment processor terms, connected-account terms, seller payout rules, tax rules, reserves, chargeback rules, and refund procedures may apply.
  • 7.4 Seller Accuracy & Safety. Sellers must provide accurate, complete, and non-misleading descriptions; disclose condition, repairs, damage, age, serial numbers where appropriate, recalls, known defects, missing parts, and safety concerns; and represent that they own or have the right to sell listed items. Sellers are solely responsible for legal compliance and for ensuring equipment is safe, airworthy, and lawfully transferable.
  • 7.5 Buyer Inspection. Buyers must inspect items, verify ownership and authenticity, ask appropriate questions, and obtain qualified professional evaluation before use. Used aviation gear can be unsafe even when it appears normal.
  • 7.6 Shipping, Returns, and Disputes. Unless a future WingVoyagers checkout flow states otherwise, shipping, pickup, returns, refunds, chargebacks, and disputes are between buyer and seller. Sellers must honor all legally required cancellation, shipping-delay, refund, recall, warranty, and consumer-protection obligations.
  • 7.7 Verified Resellers. Only verified resellers may post gear listings when that gate is enabled. Verification is discretionary and informational only. It does not guarantee delivery, authenticity, quality, safety, legality, insurance, or a seller's trustworthiness.
  • 7.8 Seller Terms. Sellers must also comply with the Marketplace Seller Terms, which are incorporated into these Terms.

8) Your Mandatory Consumer Rights

Nothing in these Terms limits statutory or mandatory consumer rights that cannot be waived under applicable law. If local law gives you greater protection than these Terms, local law controls to that extent.

  • Professional sellers must honor legally required return, refund, warranty, cancellation, delivery, and misrepresentation remedies.
  • EU/UK consumers who buy from a professional seller may have withdrawal rights, cooling-off rights, conformity guarantees, and complaint rights that vary by product and transaction type.
  • U.S. sellers who accept prepaid online orders must have a reasonable basis for advertised shipping times and must handle delays, cancellations, and prompt refunds as required by law.
  • If safety, fraud, non-delivery, misrepresentation, or a defective aviation item is implicated, report it through in-app tools or [email protected] so we can review possible policy violations.

9) Trainers, Schools, and Instruction

  • 9.1 Our Role. WingVoyagers is not your instructor, guide, flight school, certifying body, or safety supervisor. Trainers, schools, coaches, guides, and organizers are independent third parties, not employees, partners, agents, or joint venturers of WingVoyagers.
  • 9.2 Verification Is Limited. A Verified Trainer, school, reseller, badge, profile label, or search placement means only that we reviewed certain information at a point in time. It is not a license, certification, endorsement, warranty of competence, or safety guarantee.
  • 9.3 Trainer Obligations. Trainers and schools must provide accurate information, maintain required credentials, permissions, ratings, and insurance, comply with applicable laws and site rules, operate within their scope of practice, inspect equipment, use prudent safety practices, obtain participant waivers and parental consent where required, and promptly update any lapsed or changed credentials.
  • 9.4 User Acknowledgment. You must independently evaluate trainers and schools, request current credentials and insurance, check references, review waivers, and decide whether the activity is appropriate for you.
  • 9.5 Trainer/School Agreement. Trainers and schools must also comply with the Trainer and School Agreement, which is incorporated into these Terms.

10) Events, Meetups, Groups, and Fly-In Listings

  • 10.1 Third-Party Events. Many events, meetups, groups, fly-ins, and training sessions are user-organized. We do not create, supervise, vet, or control organizers, participants, locations, aircraft, equipment, weather, security, medical support, or on-site management unless expressly stated in writing.
  • 10.2 Host Requirements. Hosts and organizers must follow applicable laws, permits, landowner rules, airspace rules, and safety practices and obtain required insurance, waivers, and parental consent where applicable.
  • 10.3 Listings. Submitted event details may be reviewed, accepted, declined, edited, formatted, or removed at our discretion. Publication does not create an endorsement, verification, duty, or responsibility for the event. Attendees must confirm final details with the host or organizer.
  • 10.4 Release. To the maximum extent permitted by law, you release WingVoyagers from claims arising from attendance, hosting, instruction, travel, flying, ground handling, equipment use, property damage, injury, death, cancellation, or disputes connected to events or meetups.
  • 10.5 Event Host Waiver. Hosts and organizers must comply with the Event Host Waiver and Release, which is incorporated into these Terms where applicable.

11) Weather, Maps, Airspace, Site Information, and WingVoyagers AI

General Planning Information. Weather overlays, forecasts, site pins, ratings, comments, airspace visuals, map layers, event locations, and AI summaries may be inaccurate, lagging, incomplete, misinterpreted, or unavailable. They are general convenience tools, not real-time safety, operational, regulatory, or emergency information.

Independent Verification. You must independently verify weather, NOTAMs, airspace, temporary restrictions, site permissions, terrain, hazards, and local conditions using authoritative sources and on-the-ground observation before flying.

WingVoyagers AI - Ask WingVoyagers and WingVoyagers Maintenance

This Section applies to Ask WingVoyagers, WingVoyagers Maintenance, and any other feature we identify as artificial intelligence or AI-assisted (collectively, the "AI Features"). When you use an AI Feature, you are interacting with an automated system, not a human pilot, instructor, mechanic, rigger, meteorologist, regulator, emergency service, or WingVoyagers representative. Text, images, summaries, recommendations, citations, and other material generated by an AI Feature are "AI Output."

  • 11.1 What the AI Features Do. Ask WingVoyagers is a planning and discovery aid for WingVoyagers information such as flying spots, discipline-specific forecast windows, airspace and TFR availability, events, trainers, travel considerations, and related pilot questions. WingVoyagers Maintenance uses descriptions and optional photos to help organize a maintenance case, identify a possible part family or cause, suggest safe next checks, and locate supporting sources or possible replacement paths. These are informational and triage tools only.
  • 11.2 AI Output Can Be Wrong. AI Output is generated probabilistically and can be inaccurate, incomplete, inconsistent, outdated, misleading, or fabricated. It can misunderstand your question or photo, omit a material fact, confuse similar equipment, or cite a source that is wrong, changed, incomplete, or no longer available. A citation, link, structured card, apparent detail, or confident tone does not make AI Output verified or authoritative.
  • 11.3 Ask WingVoyagers Is Not a Go/No-Go Decision. Ask WingVoyagers does not provide flight instruction, a regulatory weather briefing, a flight release, airspace authorization, or a go/no-go decision. Before flying, you must independently verify current official weather, NOTAMs, TFRs and airspace, site and landowner rules, access, obstacles, terrain, launch and landing conditions, equipment, and your own training, fitness, currency, and limits. Weather overlays, modeled forecasts, maps, site data, and planning indicators can be delayed, unavailable, or wrong.
  • 11.4 Maintenance Is Not Inspection or Airworthiness Approval. A photo match or likely diagnosis is a hypothesis, not proof of identity, condition, compatibility, serviceability, installation, repair, or airworthiness. WingVoyagers Maintenance does not physically inspect equipment, replace the applicable current manufacturer manual, authorize a repair or modification, certify return to service, or replace a qualified technician, mechanic, manufacturer, or rigger. Confirm exact manufacturer, model, variant, markings, part number, procedures, limits, and compatibility before acting. Keep damaged, uncertain, improvised, or unverified equipment out of service until it has been appropriately verified. Do not perform live-engine, spinning-propeller, exposed-ignition, pressurized-fuel, structural-load, reserve-deployment, or similar hazardous testing based on AI Output.
  • 11.5 No Emergency or In-Operation Use. Do not use or rely on an AI Feature while actively piloting, operating hazardous equipment, or responding to an emergency or imminent hazard. Use your training, applicable emergency procedures, and appropriate emergency, regulatory, manufacturer, or qualified professional resources. The AI Features are not monitored as an emergency channel and no professional is reviewing your conversation in real time.
  • 11.6 Account Context and Personalization. To make an answer more relevant, an AI Feature may use information associated with your WingVoyagers account, including recent conversation context, pilot preferences, discipline, home location, flight hours, listed gear, saved launches, and structured Maintenance case details. Account information is treated as user-supplied context, not proof of your identity, skill, readiness, equipment condition, or personal limits. You are responsible for keeping it accurate and for checking whether it was interpreted correctly.
  • 11.7 Your AI Inputs. Prompts, descriptions, photos, case details, and other material you submit to an AI Feature are "AI Inputs." You represent that you have the rights and permissions needed to submit them. Do not include credentials, government ID numbers, medical records, payment-card data, another person's confidential information, or other sensitive information that is not necessary for the request. For AI Inputs you do not intentionally make public, the license in Section 4.1 is limited to receiving, hosting, reproducing, transmitting, analyzing, and using them to provide, secure, support, evaluate, and improve the AI Features and to comply with law. We will not use private AI Inputs or original Maintenance photos in advertising without your permission.
  • 11.8 Processing, Saved History, and Photos. AI Inputs, relevant conversation or account context, and attached photos may be sent to OpenAI and other service providers that support the AI Features and their source lookups. WingVoyagers may save account-scoped chat text, AI Output, citations, source links, response and usage metadata, pilot preferences, and structured Maintenance case details and outcomes. A saved Maintenance case is a convenience record, not an official maintenance log, inspection record, regulatory record, diagnosis, or return-to-service authorization. Original Maintenance photo bytes and data URLs are not retained in WingVoyagers saved chat history or Maintenance case records, although filenames and attachment-presence metadata may be retained, and the photos are processed by the AI provider when you submit them. Photos are not added to the retained Maintenance catalog automatically. See our Privacy Policy for more information about collection, disclosure, retention, and privacy rights.
  • 11.9 Feedback and Product Improvement. If you submit a rating or optional positive or negative written feedback, we may retain the response identifier, rating, model and mode information, your comment, and limited prompt and answer excerpts for authorized review. Optional written feedback may be sent to OpenAI with short prompt and answer excerpts to generate a generalized learning note. Eligible non-sensitive, non-injection notes may guide the approach of future Ask WingVoyagers and WingVoyagers Maintenance answers. Raw feedback text is never directly inserted into runtime prompts. Learning notes are not facts and cannot modify the system, safety, grounding, privacy, or tool rules for either agent; those rules remain fixed. This process is not model-weight retraining, and submitted photos are not automatically made reference images. Section 4.4 also applies to feedback.
  • 11.10 AI Output and Intellectual Property. As between you and WingVoyagers, and only to the extent permitted by law and any applicable third-party rights, you may use AI Output generated for you in compliance with these Terms. AI Output may not be unique, and other users may receive the same or similar material. We do not represent that AI Output is copyrightable, exclusive, non-infringing, or suitable for publication or commercial use. You are responsible for reviewing AI Output and for how you use, share, or rely on it.
  • 11.11 Access, Limits, and Changes. AI Features may be beta, invitation-only, or otherwise restricted. We may apply account- and network-based rate limits, cost or usage caps, request-size limits, safety controls, or eligibility rules; refuse a request; change models, sources, tools, or functionality; or suspend or discontinue access, subject to applicable law. Free access, promotional access, quotas, and test grants have no cash value, are not transferable, and do not guarantee future access or service levels. You may not bypass access controls or usage limits, automate high-volume extraction, probe for hidden instructions or private data, or use an AI Feature to facilitate unlawful or unsafe conduct.

12) Fees, Subscriptions, and Payments

  • 12.1 Limited Free AI Access; Optional Paid AI Access. WingVoyagers AI includes limited free use. Optional paid plans or additional usage may be offered in the future. You will not be charged unless you choose a paid option and authorize the purchase. Free AI access remains subject to the access and usage limits in Section 11.11.
  • 12.2 Paid AI Plans or Credits. Paid AI access may be offered through subscriptions, prepaid AI credits, usage bundles, or another disclosed purchase model. Before purchase, the applicable checkout will state the price, included usage, billing period, renewal terms, expiration terms if any, cancellation method, refund rules, and applicable taxes. If a plan uses prepaid credits or a hard usage cap, requests may be blocked when the balance or cap is exhausted unless you authorize another purchase. Credits are not cash, are not transferable, and are not refundable except as stated at purchase or required by law.
  • 12.3 Future Marketplace Checkout. Stripe and other payment providers are not currently used for WingVoyagers marketplace checkout. If marketplace payment features are introduced, the applicable checkout page, processor terms, seller terms, refund policy, tax disclosures, and statutory rights will apply.
  • 12.4 Taxes. If paid features or checkout are introduced, applicable taxes may be disclosed at purchase or handled by sellers, platforms, or processors as required by law.

13) Third-Party Services & Links

We are not responsible for third-party services, content, products, merchants, trainers, schools, event hosts, payment processors, maps, weather providers, messaging providers, analytics providers, app stores, or external sites, even if accessed through the Services. Those providers are independent of WingVoyagers and their terms and privacy policies govern your relationship with them.

14) Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. Where consent is legally required, we ask for it separately from these Terms.

15) Accessibility

We aim to make WingVoyagers usable by people with disabilities. If you have trouble accessing content or features, contact [email protected] with the page, feature, device, browser, and assistive technology involved so we can review the issue.

16) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, SAFETY, ACCURACY, AND RELIABILITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, CURRENT, COMPLETE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.

Any verification badge, trainer label, reseller label, school label, profile boost, or similar indicator is informational only and does not constitute certification, licensure, endorsement, employment, agency, warranty, or safety guarantee by WingVoyagers.

17) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINGVOYAGERS LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, PARTNERS, SUPPLIERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, PROPERTY DAMAGE, OR AVIATION-RELATED LOSSES ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS IN THE AGGREGATE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNTS YOU PAID TO WINGVOYAGERS FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations; if so, the above applies to the fullest extent permitted by law.

You are solely responsible for your decisions, equipment, training, condition checks, transactions, travel, flights, actions, and review and use of AI Output. Any crash, accident, incident, equipment damage, repair or compatibility decision, transaction loss, event issue, or training issue arising from your activities or use of the Services is your own responsibility to the maximum extent permitted by law.

18) Indemnification

You agree to indemnify, defend, and hold harmless WingVoyagers from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, your content or listings, your interactions or transactions with other users, your instruction, events, hosting, flying, equipment, violation of laws or these Terms, or activities at any site, event, meetup, training session, or marketplace exchange.

19) Suspension & Termination

We may suspend or terminate access at any time with or without notice, including for violations, safety risk, fraud risk, legal risk, inactivity, technical abuse, or harm to other users. You may delete your account at any time. 20) Dispute Resolution; Arbitration; Class-Action Waiver (U.S.)

  • 20.1 Informal Resolution. Contact us first at [email protected]. Most issues can be resolved informally within 30 days.
  • 20.2 Arbitration Agreement. Any U.S. dispute arising out of or related to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, unless an exception below applies. Venue will be in Orange County, California, unless the AAA Rules permit or the parties agree to a remote hearing. The arbitrator may award individual remedies available under applicable law.
  • 20.3 Class/Representative Actions Waiver. You and WingVoyagers agree that each may bring claims only in an individual capacity, not as a class member or representative. Class arbitrations, class actions, private attorney general actions, and consolidation of arbitrations are not permitted to the maximum extent allowed by law.
  • 20.4 Small Claims & IP. Either party may bring an individual claim in small claims court or seek injunctive relief for IP misuse.
  • 20.5 Opt-Out. You may opt out of arbitration within 30 days of account creation by sending written notice to [email protected] with your name, account email, and a clear statement of opt-out.

21) Governing Law & Venue

These Terms are governed by the laws of the State of California without regard to conflicts rules. Subject to the arbitration provision, the exclusive venue for disputes will be the state and federal courts located in Orange County, California, and you consent to personal jurisdiction there. Nothing in this Section limits any non-waivable consumer protection, privacy right, or mandatory legal right you have under the laws of your country or region of residence.

22) Export Controls & Sanctions

You agree not to use the Services if you are located in, under control of, or a national or resident of any country or entity embargoed by the United States, and not to export or re-export any part of the Services in violation of export, sanctions, or trade laws.

23) Changes to Services or Terms

We may change the Services and these Terms as permitted by applicable law. For material changes, we will provide notice, for example by emailing your account address or showing an in-app notice that links to the updated Terms. We may require acceptance before completing onboarding or using affected features. Non-material changes are effective upon posting unless stated otherwise, and continued use after changes take effect signifies acceptance to the extent allowed by law.

24) Miscellaneous

  • 24.1 Entire Agreement. These Terms and policies incorporated by reference are the entire agreement between you and us for the Services.
  • 24.2 Severability. If any provision is unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in effect.
  • 24.3 Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, financing, reorganization, or sale of assets.
  • 24.4 No Waiver. Our failure to enforce a provision is not a waiver.
  • 24.5 Electronic Communications. You consent to receive notices electronically. We may send account, security, transactional, legal, and where permitted by law and consent, promotional emails to your account email or through the Services. You may opt out of non-essential marketing emails using unsubscribe mechanisms in those messages; we may still send service-related and legal notices.
  • 24.6 Beta Features. Some features may be labeled beta, preview, experimental, or similar and may be unstable. Use them at your own risk.
  • 24.7 App Stores. If you download our app from an app store, the store is not responsible for support or claims and you must comply with store terms.

25) Aviation-Specific Rules

  • No Site Vetting. Spot and site listings are user-generated. WingVoyagers does not inspect, maintain, approve, or certify any launch, landing zone, kiting field, route, or event site.
  • Training & Currency. You agree to obtain and maintain appropriate training, ratings, qualifications, supervision, and currency before flying and to fly within your personal limits.
  • Equipment. You are solely responsible for inspection, maintenance, airworthiness, compatibility, transport, storage, and legal compliance of your equipment.
  • Third-Party Guides and Instruction. Anyone offering instruction, tandem activity, guiding, coaching, towing, or equipment support does so independently and must hold required qualifications, permissions, insurance, and waivers.
  • Release. To the maximum extent permitted by law, you release and discharge WingVoyagers from claims arising from aviation activities connected to or discovered through the Services, including claims based on negligence, except where such a release is prohibited by law.

26) Community Guidelines Summary

  • Be helpful and respectful; safety first.
  • Do not publish exact coordinates for sensitive or restricted sites if doing so would violate permissions or increase risk.
  • Accurately disclose conditions, access limits, hazards, and uncertainty.
  • Do not shame incidents; focus on factual safety learning and respectful reporting.
  • No hate speech, harassment, illegal content, fraud, spam, or unsafe encouragement.
