By creating an account, accessing, or using WingVoyagers websites, apps, services, features, or marketplace (collectively, the “Services”), you agree to these Terms & Conditions (the “Terms”). If you do not agree, do not use the Services.
Assent & Versioning. By clicking “I Agree,” creating an account, or accepting the Terms in the in-app pop-up after we provide notice of a material update, you consent to these Terms. We log consent (user ID, timestamp, IP, and Terms version) as proof of agreement. For material updates we give at least 30 days’ advance notice via email and an in-app pop-up that links to the updated Terms, and you must accept the updated Terms in that pop-up before continuing to use the Services.
1) Eligibility & Accounts
- 1.1 Minimum Age. You must be at least 13 years old to use general social features and at least 18 to buy/sell on the marketplace or attend meetups/events we host or list. If you are under 18, you represent you have parental/guardian consent and supervision.
- 1.2 Account Registration. You agree to provide accurate, current information and to keep it updated. You are responsible for safeguarding your credentials and for all activity on your account.
- 1.3 One Person, One Account. Do not share your account or impersonate others.
- 1.4 Business Accounts. If you create a business/seller account, you represent you have authority to bind that entity and agree that “you” includes the entity.
2) Critical Safety Notice – Aviation Sports Are Inherently Dangerous
- 2.1 Assumption of Risk. Paramotoring/paragliding and related activities involve significant risk of injury or death. You voluntarily assume all risks arising from your participation, including risks from pilot error, equipment failures, weather, terrain, obstacles, site conditions, and actions/omissions of others.
- 2.2 No Instruction or Professional Advice. WingVoyagers is not a flight school, instructor, guide, or emergency service. Information in the app—including flight-spot listings, ratings, weather overlays, comments, AI summaries, or messages—may be inaccurate, incomplete, or out of date and must not be relied upon as instruction, certification, or safety guidance. Always obtain proper training, evaluate conditions in person, and make your own independent decisions.
- 2.3 Compliance With Laws. You are solely responsible for knowing and complying with all applicable laws and regulations (e.g., airspace rules, site permissions, landowner permissions, equipment and insurance requirements). We do not monitor your compliance and are not responsible for your actions.
- 2.4 Medical Acknowledgment. You are solely responsible for assessing your fitness to participate. Consult a qualified professional before any activity.
- 2.5 Emergency Services. The Services are not a substitute for emergency services (e.g., 911). Do not rely on the Services in any emergency..
3) User Conduct & Prohibited Activities
- 3.1 Rules of Use. You agree to use the Services lawfully and respectfully. You will not violate any law or third-party right (including IP, privacy, or publicity rights); post or transmit content that is illegal, hateful, harassing, sexually explicit, or that promotes harm or dangerous acts; dox, stalk, threaten, or impersonate individuals; interfere with or disrupt the Services, scrape or harvest data without written permission, or bypass security controls; provide false site/condition reports or otherwise endanger others; upload malware or attempt to access non-public areas.
- 3.2 Prohibited Items (Marketplace). Without limitation: weapons; explosives; hazardous materials; stolen goods; counterfeit items; illegal drugs or paraphernalia; medical devices requiring prescriptions; recalled items; items that violate export/sanctions laws; or items prohibited by carriers or local law. We may publish category-specific rules.
- 3.3 Naming Restrictions. You agree not to form, register, or operate any company, entity, or business under the name “WingVoyagers” or any confusingly similar mark without our prior written consent.
4) User Content & Licenses
- 4.1 Your Content. You retain ownership of content you submit (e.g., posts, comments, photos, videos, gear listings, ratings). You grant WingVoyagers a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (e.g., formatting), publish, publicly display and perform, distribute, and otherwise use your content for operating, improving, and promoting the Services.
In plain language:
- “Worldwide” means your posts can appear wherever the service is available.
- “Non-exclusive” keeps your ownership—share or reuse your content anywhere else.
- “Royalty-free” lets us show and adapt it without paying fees, while you still own it.
- “Sublicensable” allows trusted partners (like hosting or analytics tools) to handle it so the platform works.
- 4.2 Content Responsibility. You are solely responsible for your content and represent that you have all rights necessary to grant the above license and that your content does not violate these Terms or any law.
- 4.3 Moral Rights Waiver. To the extent permitted by law, you waive any moral rights in content you provide.
- 4.4 Feedback. You grant us a perpetual, irrevocable, royalty-free license to use ideas/suggestions without restriction or compensation.
- 4.5 Monitoring & Enforcement. We may remove or restrict content or accounts at our discretion (e.g., suspected violations, risk of harm), but we have no obligation to monitor content.
5) Intellectual Property; DMCA
- 5.1 Our IP. The Services, including brand, designs, UI, software, and databases, are protected by IP laws. You may not copy, modify, distribute, reverse engineer, or create derivative works except as expressly permitted.
- 5.2 DMCA Policy. If you believe content infringes your copyright, send a DMCA notice to WingVoyagers Legal Department, 6000 Warner Ave, Suite D, Huntington Beach, CA 92647, USA, email [email protected], including: (a) your contact info, (b) identification of the copyrighted work and the allegedly infringing material, (c) a statement of good-faith belief, (d) a statement under penalty of perjury that the information is accurate and that you are the owner/authorized agent, and (e) your physical or electronic signature. We may remove content and terminate repeat infringers.
6) Marketplace Terms (Buyer–Seller Platform)
- 6.1 Platform Role. WingVoyagers is a venue where users list, sell, and buy items and services (e.g., gear, training offered by third parties). We are not a party to transactions between buyers and sellers and do not guarantee listings, quality, ownership, safety, legality, pricing, shipping, or returns.
- 6.2 Payments. Payments may be processed by third-party processors (e.g., Stripe). You agree to comply with their terms. We may charge fees and taxes disclosed at checkout. You authorize us/our processors to charge your payment method.
- 6.3 Shipping; Risk of Loss. Sellers are responsible for timely shipping and providing tracking. Risk of loss passes per the shipping terms between buyer and seller.
- 6.4 Returns/Refunds. Sellers set their own policies unless we state otherwise. Disputes are between buyer and seller. We may (but are not required to) help facilitate. Your statutory consumer protections remain in place—see Section 6B ("Your Rights as a User/Consumer") for details on regional rights and escalation paths.
- 6.5 Listing Accuracy & Safety. Sellers must provide accurate descriptions and comply with all laws (e.g., export controls, hazmat shipping). Sellers are solely responsible for ensuring equipment is airworthy and safe. Buyers must inspect items and obtain qualified professional evaluations before use.
- 6.6 Prohibited Services. Listings may not offer illegal instruction, prohibited activities, or services requiring licenses/certifications that the seller lacks.
6A) Trainers & Instruction Program (Verification, No Endorsement, Requirements)
Definitions. A Trainer is a user who offers instruction, guiding, or coaching. A Verified Trainer (or similar badge) indicates only that we reviewed certain documents at a point in time (e.g., certifications, ratings, proof of insurance) provided by the trainer and/or publicly available from third parties. It is not a license, certification, endorsement, warranty of competence, or safety guarantee.
- 6A.1 Our Role. WingVoyagers is not your instructor or guide. We do not supervise lessons, assess in-field skills, or control training operations. Verification is administrative and may rely on self-reported or third-party information that could be incomplete, inaccurate, or out of date.
- 6A.2 No Endorsement; No Guarantee. Verified status, profile labels, or search boosts are informational only. They do not guarantee legality, insurance coverage, qualifications, experience, airworthiness of equipment, or safety of any activity or site.
- 6A.3 Trainer Obligations. Trainers represent and warrant that they will: (a) provide accurate, non-misleading information and promptly update any changes; (b) maintain all required licenses, ratings, certifications, permits, and permissions; (c) comply with all applicable laws, site/landowner rules, and airspace regulations; (d) maintain appropriate insurance (e.g., general liability and, where applicable, professional/instructor liability) with coverage limits customary for the industry [recommended minimums to be finalized]; (e) ensure equipment is properly inspected and airworthy; (f) implement prudent safety practices (pre-flight briefings, student-to-instructor ratios, weather/airspace checks, emergency planning); (g) not exceed their rating/scope of practice; and (h) obtain participant waivers and, where applicable, parental consent for minors. Trainers must provide proof of credentials/insurance to WingVoyagers upon request.
- 6A.4 User Acknowledgment. You understand that any verification is limited and may be based on self-reported information. You must independently evaluate trainers (e.g., ask for current credentials, insurance, references, waivers) and you assume all risks of training activities.
- 6A.5 Independent Contractors; No Agency. Trainers are independent third parties, not employees, partners, agents, or joint venturers of WingVoyagers. WingVoyagers is not vicariously liable for acts or omissions of trainers or participants.
- 6A.6 Additional Trainer Indemnity. In addition to Section 14, trainers agree to indemnify, defend, and hold harmless WingVoyagers from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to instruction or guiding they provide, including alleged negligence, misrepresentation, or statutory violations by the trainer, except to the extent prohibited by law.
- 6A.7 Suspension/Revocation. WingVoyagers may, in its discretion, deny, suspend, or revoke Verified status or marketplace access (and remove related content/listings) for any reason, including suspected misrepresentation, unsafe practices, lapsed credentials/insurance, or user reports.
- 6A.8 Reporting & Cooperation. Users can report suspected fraud, safety issues, or policy violations via in-app tools or [email protected]. We may request documentation, contact third-party organizations, or notify appropriate authorities where safety is implicated.
- 6A.9 Insurance & Proof. We may request proof of insurance but do not continuously monitor coverage. Any verification is a snapshot and may become inaccurate without notice. Trainers must maintain continuous coverage where required and notify participants of any limitations or exclusions.
- 6A.10 Affiliate Links & Commissions. Some trainers may list affiliate products or links (for example, on their profiles or in content). Purchases made through those links may earn the trainer a commission. WingVoyagers is not a party to such arrangements and does not endorse or guarantee any third-party products or merchants. Trainers are solely responsible for making clear and conspicuous disclosures where required by law (e.g., FTC, CMA/ASA guidance) and for ensuring that any statements about products are truthful and not misleading. Pricing, availability, fulfillment, returns, and customer service are controlled by the third-party merchant.
6B) Your Rights as a User/Consumer
Marketplace participation does not limit any statutory or mandatory consumer rights available to you under applicable law. The remedies below supplement any seller policies and apply to transactions made through WingVoyagers.
- Refund & Return Windows. You may be entitled to cancel a purchase and obtain a refund within the window mandated by your jurisdiction (for example, many U.S. states provide specific return periods for defective or misdescribed goods, and California residents may access enhanced remedies under the Song-Beverly Consumer Warranty Act). Sellers must honor those timeframes when they apply.
- EU/UK Withdrawal Rights. If you reside in the European Union or United Kingdom and purchase from a professional seller, you generally have a 14-day cooling-off period to withdraw without giving a reason, plus a further 14 days after withdrawal to return physical goods. Digital services that begin immediately may waive this right only with your express consent as required by law.
- Misrepresentation or Defective Goods. Where a seller misrepresents an item or it arrives damaged/unsafe, you may request a repair, replacement, or refund consistent with local consumer protection statutes (e.g., U.S. FTC rules, EU/UK Consumer Rights Acts). Provide documentation through in-app messaging or email so we can help route the issue to the seller and, if needed, escalate.
- Support & Escalation. Attempt to resolve disputes directly with the seller first. If unsuccessful or if safety is implicated, contact WingVoyagers Support at [email protected], via the in-app report tools, or by mail at 3010 Park Newport, Apt 209, Newport Beach, CA 92660. We will review for potential policy violations and inform you of any additional remedies available.
- Data & Privacy Rights. Requests to access, correct, delete, or port personal data should follow the procedures in our Privacy Policy. Regional privacy rights (e.g., GDPR, UK GDPR, CCPA/CPRA) are handled through those channels.
- Local Variations. Additional rights may apply based on where you live (for example, Québec’s Consumer Protection Act, Australian Consumer Law guarantees, or extended return rights in certain U.S. states). When local law offers greater protection than these Terms, local law prevails.
7) Events, Meetups & Group Activities (“Squads”)
- 7.1 Third-Party Events. Many events/meetups are user-organized. We do not supervise, vet, or control organizers, participants, or locations. Participation is at your own risk.
- 7.2 Host Requirements. If you host, you must follow applicable permits, landowner rules, and safety practices and obtain any required insurance.
- 7.3 Release for Events. To the maximum extent permitted by law, you release WingVoyagers from claims arising from attendance, including injury, death, property damage, or loss.
8) Weather, Maps, and Site Information; AI Features
- 8.1 No Reliance. Weather overlays, site pins, airspace visuals, and AI summaries may be inaccurate, lagging, or incomplete. They are provided for convenience only. You must independently verify conditions and airspace.
- 8.2 Third-Party Data. Maps/weather/providers are third-party services. Their terms apply; outages or inaccuracies may occur.
- 8.3 AI Output. AI features can generate errors or hallucinations. Do not rely on AI for safety-critical decisions. You remain solely responsible for your actions.
9) Fees & Subscriptions (Not Currently Offered)
- 9.1 No Fees Today. The Services are currently provided without subscription fees. Some optional paid features may be introduced later with separate notice and updated terms.
- 9.2 Taxes. If paid features are introduced, applicable taxes will be disclosed at the time of purchase.
- 9.3 Refunds. Because there are no paid features at this time, refund terms are not applicable. If we introduce paid features, the then-current refund policy will apply. Statutory refund or withdrawal rights will continue to be honored as outlined in Section 6B.
10) Third-Party Services & Links
We are not responsible for third-party services, content, or sites (including payment processors, maps, weather, messaging, or training providers). Your use is at your own risk and subject to their terms.
11) Privacy
Your use is subject to our Privacy Policy, which explains how we collect, use, and share information. By using the Services, you consent to our data practices. [Link to your Privacy Policy]
12) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT IS CURRENT OR RELIABLE.
Trainer-Specific Disclaimer. Any Verified Trainer badge, profile label, or similar indicator is informational only and does not constitute a certification, licensure, or endorsement by WingVoyagers. We do not supervise instruction or control training decisions. To the maximum extent permitted by law, WingVoyagers disclaims responsibility for acts or omissions of trainers, including alleged negligence, misrepresentation, or failure to maintain required credentials or insurance.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINGVOYAGERS AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, SUPPLIERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS IN THE AGGREGATE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations; if so, the above applies to the fullest extent permitted by law.
14) Indemnification
You agree to indemnify, defend, and hold harmless WingVoyagers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Services, (b) your content or listings, (c) your interactions or transactions with other users, (d) your violation of laws or these Terms, or (e) your activities at any site/event.
15) Termination & Suspension
We may suspend or terminate access at any time with or without notice (e.g., for violations, risk, inactivity). You may delete your account at any time. Sections that by nature should survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution) survive termination.
16) Dispute Resolution; Arbitration; Class-Action Waiver (U.S.)
- 16.1 Informal Resolution. Contact us first; most issues can be resolved informally within 30 days.
- 16.2 Arbitration Agreement. Any dispute arising out of or related to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under itsConsumer Arbitration Rules(the “AAA Rules”). Venue will be in Orange County, California, unless the AAA Rules permit or the parties agree to a remote hearing. You are responsible for your share of any filing or administration fees as set out in the AAA Rules (currently capped at $200 for consumers), and WingVoyagers will pay the remaining AAA filing, administration, and arbitrator fees unless the arbitrator determines your claims are frivolous. We will also cover any AAA-required hearing fees for claims under $25,000. You may request an in-person or remote hearing by following the AAA procedures and notifying both the AAA and WingVoyagers, and the arbitrator will accommodate reasonable requests consistent with the AAA Rules. Discovery will be limited to the exchange of relevant, non-privileged documents and up to one deposition per side, unless the arbitrator allows additional discovery for good cause. The arbitrator may award individual remedies available under applicable law, including monetary, injunctive, or declaratory relief, and may award attorneys’ fees and costs when authorized by statute. - 16.3 Class/Representative Actions Waiver. You and WingVoyagers agree that each may bring claims only in your/its individual capacity, not as a class member or representative. Class arbitrations, class actions, private attorney general actions, and consolidation of arbitrations are not permitted.
- 16.4 Small Claims & IP. Either party may bring an individual claim in small claims court or seek injunctive relief for IP misuse.
- 16.5 Opt-Out. You may opt out of arbitration within 30 days of account creation by sending written notice to [email protected] with your name, account email, and a clear statement of opt-out.
17) Governing Law & Venue
These Terms are governed by the laws of the State of California (without regard to conflicts rules). Subject to the arbitration provision, the exclusive venue for disputes will be the state and federal courts located in Orange County, California, and you consent to personal jurisdiction there. However, nothing in this Section limits any non-waivable consumer protections or mandatory legal rights you have under the laws of your country or region of residence. EU/UK residents may also contact their local consumer protection or supervisory authority, or submit disputes through the European Commission’s Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr/).
18) Export Controls & Sanctions
You agree not to use the Services if you are located in, under control of, or a national/resident of any country or entity embargoed by the U.S. and not to export or re-export any part of the Services in violation of export laws.
19) Changes to the Services or Terms
We may change the Services and these Terms at any time. For material changes, we will provide at least 30 days’ advance notice via both (i) email to your account address and (ii) an in-app pop-up that links to the updated Terms. You must accept the updated Terms in the in-app pop-up before continuing to use the Services. Non-material changes are effective upon posting unless stated otherwise, and your continued use after the effective date signifies acceptance.
20) Miscellaneous
- 20.1 Entire Agreement. These Terms and any policies referenced (e.g., Privacy Policy, Marketplace Rules, Community Guidelines) are the entire agreement between you and us.
- 20.2 Severability. If any provision is unenforceable, it will be enforced to the maximum extent and the remainder will remain in effect.
- 20.3 Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- 20.4 No Waiver. Our failure to enforce a provision is not a waiver.
- 20.5 Notices; Electronic Communications. You consent to receive notices electronically. We may send notices via email to your account email or by posting in the Services.
- 20.6 Beta Features. Some features may be labeled “beta,” “preview,” or similar and may be unstable. Use at your own risk.
- 20.7 App Stores. If you download our app from an app store, the store is not responsible for support or claims. You agree to comply with store terms.
21) Aviation-Specific Addendum (Recommended)
- (A) No Site Vetting. Site/spot listings are user-generated; WingVoyagers does not inspect, maintain, or certify any site. Conditions can change quickly; obstacles may exist; permissions may be required.
- (B) Training & Currency. You agree to obtain and maintain appropriate training, ratings, and currency from qualified instructors/organizations before flying and to fly within your personal limits.
- (C) Equipment. You are solely responsible for the inspection, maintenance, airworthiness, and legal compliance of your equipment.
- (D) Third-Party Guides/Instruction. If users offer instruction or guiding, they do so independently and must hold any required qualifications and insurance. WingVoyagers is not responsible for them and is not your instructor.
- (E) Waiver & Release. To the maximum extent permitted by law, you release and discharge WingVoyagers from any and all claims arising from participation in aviation activities connected to or discovered via the Services, including claims based on negligence (but not gross negligence or willful misconduct where such a release is prohibited).
- (F) Indemnity. You agree to indemnify us from claims brought by third parties (e.g., landowners, other pilots, bystanders) related to your activities.
22) Community Guidelines (Short-Form Summary)
- Be helpful and respectful; safety first.
- Do not publish exact coordinates for sensitive or restricted sites if doing so would violate permissions.
- Accurately disclose conditions and hazards. If you aren’t sure, don’t post.
- No shaming of incidents; focus on learning.
- No hate speech, harassment, or illegal content.

1) Scope
This Privacy Policy explains how we collect, use, disclose, and protect information about users of our websites, apps, and related services (the Services). If we post a different policy for a specific feature, that policy controls for that feature.
2) Information We Collect
- You provide: account details (name, email, username), profile fields (bio, gear lists), posts/comments/images/video, messages, marketplace listings, support requests.
- Automatic: device and usage data (IP, device type, OS/browser, app version, crash logs, pages/screens viewed, referrer, timestamps), coarse location inferred from IP. If you enable it, we may collect precise location for features you opt into (e.g., adding a site pin)—you can turn this off in device settings.
- Cookies/Similar Tech: essential cookies, analytics cookies, and optional preferences. See Cookies & Tracking below.
- Payments/Marketplace: processed by third-party processors (e.g., Stripe). We receive limited details (status, last4, brand, transaction IDs) but do not store full card numbers.
- Third-Party Sources: map/weather providers, anti-fraud/abuse services, and analytics.
3) How We Use Information
- Provide, operate, and improve the Services; personalize content and features.
- Safety and moderation (investigate misuse, fraud, or harmful content).
- Communicate with you (service notices, security alerts, changes).
- Analytics, debugging, and product development.
- Legal compliance and enforcing our Terms.
- No sale/share for ads: We do not sell or “share” personal information for cross-context behavioral advertising at this time.
4) Legal Bases (EEA/UK users)
When applicable, we rely on: performance of a contract (providing Services), legitimate interests (security, analytics, product improvement), consent (where required, e.g., certain cookies or precise location), and compliance with legal obligations.

We do not permit processors to use personal information for their own purposes.
6) Retention
We retain personal information as long as needed for the purposes above: while your account is active and for a reasonable period after deletion for backups, dispute resolution, and legal requirements. Typical retention: account records and posts until you delete or request deletion; logs up to 12–18 months; payment records per tax/law. Anonymized data may be kept longer.
7) Your Rights
California (CPRA): right to know/access, delete, correct, and to non-discrimination. Because we do not sell or share personal information for cross-context behavioral advertising, the opt-out right is not applicable at this time. If that changes, we will provide a “Do Not Sell or Share My Personal Information” link and honor Global Privacy Control (GPC) signals.
EEA/UK: rights to access, rectify, erase, restrict/oppose processing, and data portability; you may withdraw consent where applicable. You also have a right to lodge a complaint with your local data authority.

8) Cookies & Tracking
We use essential cookies for sign-in and security and analytics cookies to understand usage. You can manage non-essential cookies in settings and via your browser. If we later use advertising cookies, we will request consent where required and update this Policy. We honor GPC signals when applicable.
9) Children
The Services are intended for users 13+. Marketplace features and events require 18+. We do not knowingly collect personal information from children under 13. If you believe a child has provided information, contact us to delete it.
10) Security
We implement reasonable administrative, technical, and physical safeguards; no method of transmission or storage is 100% secure. You are responsible for maintaining the secrecy of your credentials.
11) International Transfers
If you access the Services from outside the U.S., your information may be processed in the U.S. and other countries that may not provide equivalent data protection. We use appropriate safeguards where required.
12) Changes
We may update this Policy from time to time. Material changes will be notified in-app or by email. Continued use after the Effective Date indicates acceptance.
