European Terms & Conditions

Company: WingVoyagers LLC. Contact: contact@wingvoyagers.com
Acceptance is optional during this rollout. You can keep using WingVoyagers without accepting this European supplement. Mandatory legal rights apply regardless of acceptance.
1) Scope and priority
This supplement addresses users habitually resident in the European Union, the European Economic Area (including Iceland, Liechtenstein and Norway), the United Kingdom, and Switzerland. Residence and the applicable law determine your rights; language, nationality or a temporary network location alone do not determine them. A consumer is a person acting mainly outside their trade, business, craft or profession.
When you expressly accept this supplement, it forms part of your agreement with WingVoyagers alongside the general Terms & Conditions and the terms for any specific feature or transaction. For covered users, this supplement prevails over conflicting general or feature terms. Mandatory local law always prevails. These regional rules do not extend European Union legislation to the United Kingdom or Switzerland where it does not apply.
The general Terms continue to describe the Services, account rules, community standards and feature-specific responsibilities. This supplement does not open a marketplace, payment, training or other feature in a country where WingVoyagers does not offer it. Accepting it does not accept an unrelated seller, trainer, event or paid purchase agreement.
2) Eligibility and accounts
You must be at least 18 years old. Provide accurate account details, protect your credentials and notify us of suspected unauthorized access. You are responsible for activity you authorize and failures to take reasonable care; these Terms do not automatically make you liable for every unauthorized use. Business representatives must have authority to act for their organization.
You may decline or postpone this optional European agreement during the staged rollout. We will not treat opening a page, continuing to use the app, a preselected checkbox, silence or an existing general Terms receipt as acceptance of this supplement. If required acceptance is introduced later, we will give notice and a separate opportunity to review the then-current document.
3) Aviation safety and AI
Paramotoring, paragliding and related aviation activities can cause serious injury or death. Flight logs, maps, weather, terrain information, site notes, community reports, equipment estimates and AI output may be incomplete, delayed or incorrect. WingVoyagers is not an emergency service, certified navigation system, airworthiness approval, flight instructor or substitute for official information and qualified advice.
Use official airspace and weather sources, obtain landowner permissions, follow local aviation rules and inspect your equipment with qualified help. Do not operate the app while doing so would distract you from flying or controlling equipment. Safety notices describe real risks and your responsibilities; they do not waive a mandatory claim arising from our breach, negligence or unlawful conduct.
4) Service quality and consumer remedies
Where applicable consumer law requires reasonable care and skill, conformity, security updates, repair, replacement, a price reduction or termination and reimbursement, those rights remain available. They may apply to digital content or services supplied for payment and, where the law provides, services supplied in exchange for personal data. An as-is notice, beta label, feature disclaimer or refund policy does not remove those rights.
We do not guarantee that third-party weather, listings, pilots or instructors are correct or safe. This does not remove responsibilities WingVoyagers itself has under mandatory law or an express promise we make. Contact contact@wingvoyagers.com with the affected service and problem so we can assess the appropriate remedy.
5) Prices, subscriptions and marketplace transactions
Before an offered paid contract is concluded, the relevant checkout must identify the contracting trader, main features, total price and applicable taxes or additional charges, payment terms, duration, renewal conditions and cancellation information required by law. A charge or renewal requires the applicable authorization. Accepting these Terms alone does not authorize a purchase, subscription, bank debit or extra charge.
Marketplace goods, training and events are generally offered by the identified seller, instructor or organizer. Their relationship with you is separate from WingVoyagers' platform service. Statutory buyer rights depend on the transaction and whether the counterparty is a trader or private person; consumer purchase protections generally do not apply in the same way to a private sale. We do not describe every seller as a verified trader or every listing as available internationally.
The WingVoyagers Purchase Protection claim window, seller return policy and payment dispute process are additional contractual processes. They do not shorten mandatory withdrawal, conformity, guarantee or court rights. Existing country eligibility and payment restrictions continue to apply, including the current restrictions on platform-processed marketplace transactions.
6) Withdrawal and cancellation
EU/EEA and UK consumers may have a 14-day right to withdraw from an eligible distance contract without giving a reason. For services, the period generally starts when the contract is concluded; for goods, it generally starts on delivery, subject to the applicable rules. Missing required information can extend the period. Exceptions can apply, including certain leisure services for a specific date, customized goods and qualifying supplies of digital content. We will apply an exception only where its legal conditions are met.
Starting a service during that period requires your express request where the law requires it. A proportionate charge or loss of the right after full performance is available only when the applicable legal conditions are satisfied. For digital content, any loss of withdrawal rights requires the legally required prior express consent, acknowledgment, start of supply and confirmation. Opening the app, accepting this supplement or acknowledging the Privacy Policy alone satisfies none of those separate requirements.
To withdraw from a WingVoyagers contract, send a clear statement to contact@wingvoyagers.com. Please include your name, account, service or order and the date of the contract or receipt when available so we can identify it. Those details are not conditions for a valid, unequivocal withdrawal. For example: I withdraw from my contract for [service or order], concluded or received on [date]. Name: [name]. Account email: [email]. Date: [date]. You may use another unequivocal statement. For a third-party contract, notify the identified trader using its disclosed contact details. Where an online withdrawal function is required by applicable law, it must also be available; email does not replace that duty. Refunds, return costs and reimbursement timing follow the applicable law.
Switzerland does not have a general statutory cooling-off right for all online purchases. Any Swiss withdrawal right depends on the applicable law or an expressly offered cancellation or return policy. This paragraph does not remove a right provided by the trader or by law. App-store purchases also follow the relevant store's disclosed process, without removing mandatory rights against the responsible contracting party.
7) Privacy and separate choices
WingVoyagers LLC is the controller identified in the Privacy Policy. That Policy explains data categories, purposes, legal bases, recipients, retention, international processing and privacy requests. EU/EEA, UK and Swiss rights apply under their respective laws. Where applicable, you may request access, correction, erasure, restriction, portability or object to processing and complain to the competent supervisory authority.
Agreement to these Terms is not blanket consent to processing or an international-transfer safeguard. Optional marketing, analytics and other consent-based processing require their own valid choice where required. You can withdraw such consent without losing rights that arose before withdrawal. Withdrawal does not affect the lawfulness of processing based on that consent before withdrawal. Cross-border processing must rely on a lawful mechanism under the applicable law; these Terms do not assert a particular adequacy status, certification or transfer safeguard that has not been established.
An optional agreement receipt records your account, version, exact document and agreement-text hashes, server timestamp, acceptance surface and pseudonymous request evidence. It records only the agreement you actually accepted. It does not replace the general Terms receipt, accept privacy-sensitive choices for you or prove another account's agreement.
8) Your content and intellectual property
You retain ownership of your lawful content and must have the rights and permissions needed to share it. The general Terms' content license is limited by applicable law and the purposes needed to host, display, distribute and operate the Services according to your settings. It does not transfer ownership or waive non-waivable moral rights.
Removing content or closing your account remains subject to lawful evidence retention, backups and content already shared with others. Where consumer law provides for retrieval of content after termination of a digital service, those rights remain available. We do not require you to license content for an undisclosed purpose through this supplement.
9) Community rules, moderation and reports
Do not post illegal content, threats, harassment, hate, sexual exploitation, dangerous instructions, fraud, intellectual-property infringement or other content prohibited by the community rules. We may assess reports and account activity, remove content or restrict features when reasonably justified by those rules, safety, fraud prevention or law. Action must be proportionate and respect applicable fundamental and consumer rights.
Use the available report controls or email contact@wingvoyagers.com with the specific content or listing location, why you believe it is unlawful or breaches a rule, supporting information and a way to contact you. Do not include unnecessary personal information. If you believe a restriction was mistaken, use the available appeal control or contact that address with the decision and your reasons for requesting review.
Where the EU Digital Services Act or another applicable law requires it, we will provide the required statement of reasons and information about redress, review qualifying complaints fairly and without undue delay, and observe the applicable complaint period, including the six-month period where that duty applies. Available statutory rights may include certified out-of-court dispute settlement and court proceedings. Urgent protective action or legally required confidentiality may limit advance notice; neither removes redress that the law requires.
10) Changes, restrictions and account closure
We may make proportionate changes for a valid reason, such as security, legal compliance, technical compatibility or improvement of the Services. For consumer digital services, additional changes require the conditions imposed by applicable law, including clear information, no additional cost where required, advance notice on a durable medium and a right to terminate where applicable. Merely posting a material change does not override a required notice, consent or cancellation right.
We may restrict or terminate an account for a material breach, safety or security risk, fraud or a legal obligation, subject to applicable notice, reasons, review and refund rights. You may request account deletion through the available account controls or contact us. Closing an account does not remove existing transaction obligations or legally required retention, and does not remove any statutory right to recover eligible content or money.
11) Liability and indemnity
For consumers covered by this supplement, the general Terms' US$100 or prior-payments liability cap, broad damages exclusions and as-is disclaimers do not limit liability or remedies that applicable consumer law does not permit us to limit. We do not exclude or limit liability for fraud, intentional wrongdoing, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
A consumer is not required to indemnify us for our own breach or wrongdoing or to assume an unfair or unlimited defense obligation. Any recoverable loss arising from your unlawful conduct or breach remains subject to applicable law, causation, proportionality and protections against unfair terms. Business-specific obligations apply only so far as lawful and consistent with this supplement.
12) Governing law, courts and complaints
The California governing-law provision does not deprive a consumer of mandatory protections of the law of their habitual residence where those protections apply. Consumers retain access to the courts and jurisdiction protections available under applicable local law. WingVoyagers does not require a covered European consumer to bring every claim in California.
The general Terms' compulsory U.S. arbitration and class-action waiver do not apply to consumers covered by this supplement. This agreement does not require a European consumer to opt out to preserve those rights. For business users, dispute provisions apply only to the extent enforceable under the applicable law.
Contact contact@wingvoyagers.com with a complaint and relevant details. A request to contact us first does not prevent urgent relief, a regulator complaint or a court claim and does not suspend a legal deadline. Where an applicable alternative dispute resolution obligation exists, we will provide the required body and participation information. We do not claim membership of an unverified scheme. The former European Commission Online Dispute Resolution platform is closed and is not a complaint channel.
13) Electronic records and interpretation
You can print or save this document and request a copy or your acceptance details at contact@wingvoyagers.com. Electronic contracting does not waive required information on a durable medium. No term restricts a mandatory language, accessibility or information right. If a term is unenforceable, the remaining lawful terms continue only as permitted by applicable law; an unfair consumer term will not be rewritten to your disadvantage.
